Copyright material such as photographs may be used without reference to the
copyright owner under narrowly defined instances referred to as "Fair Use".
This does not include using the works to deride or ridicule or defame the
Copyright owner.

People may use copyright material for the purpose of criticism or review
without infringing copyright provided they acknowledge the author and title
of the work and provided the dealing is "FAIR".

The Federal Court emphasises that the purpose of criticism or review must be
genuine. If the person has other motives, the fact they have also engaged in
a form of criticism or review is not enough to prevent the use from
infringing copyright.

FAIR USE FOR COMEDY OR SATIRE
You can use copyright material for the purpose of parody and satire,
provided your use is "FAIR".
"Parody":

1. a humorous or satirical imitation of a serious piece of literature or
writing.
2. the kind of literary composition represented by such imitations.
3. a burlesque imitation of a musical composition.
4. a poor imitation; a travesty. Burlesque" (used as an adjective):
involving ludicrous or debasing treatment of a serious subject.

"Satire":

1. the use of irony, sarcasm, ridicule, etc in exposing, denouncing, or
deriding vice, folly etc.
2. a literary composition, in verse or prose, in which vices, abuses,
follies etc are held up to scorn, derision, or ridicule.
3. the species of literature constituted by such composition.

The new provision does not directly affect a creator's right to take legal
action if his or her work is treated in a derogatory way. However, in many
cases the use of a copyright work for parodic purposes may be defensible as
"reasonable" under the moral rights provisions.

This is great to know, now everyone can make funny sites about Bad
Professional Phototographers and in the into for the site say that they are
satire. Awesome.

"Fair use" varies from country to country. The Berne Convention is
effectively silent on the subject of fair use.

For example, in the United States, something can be fair use if it
derides or ridicules the copyright owner or original work. In fact,
criticism is the first listed reason in 17 USC 107, the section of
the U.S. Code controlling fair use. And a reference or lack thereof
is one of the lesser factors in determining fair use. (To
paraphrase Harper & Row v. Nation Enterprises, 471 U.S. 539, The
effect of the use upon the potential market for or value of the
copyrighted work is undoubtedly the single most important element
of fair use.)

Under the U.S. legal system, defamation is independent of fair use --
copyright infringement is a federal cause of action whereas
defamation falls under the purview of state law.
