Copyright infringement issues?
Hi,
I'm not a regular in here, but caught some threads that were crossposted and became curious, so looked up the subject of copyright and images posted in the "public domain" - there are so many successful court actions! But found this particular case that some may find pertinant. The court ruled in favor of Mr Curry, an ex MTV presenter, after he had posted to his website a series of pix of a family holiday. Four of these pix were then lifted and used by a gossip mag, Mr Curry sued and won! Under the proviso of "some rights reserved" rather than "All rights reserved". Read it he http://news.com.com/Creative+Commons...3-6052292.html Any views? Comments? |

Not much of a win in that the rag was simply told not to use the photos in the future, does not look like there were any damages awarded. Scott |

There are far more infringements than actions. Copyrights are regularly infringed in innumerable ways, but only the most egregious and damaging infringements usually justify legal action in the minds of copyright holders. -- Transpose mxsmanic and gmail to reach me by e-mail. |

Conclusion: Judges still know more about copyright law than your average Usenet poster. Publishing photos on the web doesn't make them public domain any more than any other form of publishing. It's just that copying is easier. -- http://ourdoings.com/ Easily organize and disseminate news and photos for your family or group. |
