Default Copyright / Protection of digital photos

Please cite an example of a use, beyond viewing, that posting to one's web
site licenses.

My point was that the copyright is not removed nor is a broad license
granted by the act of posting as you suggested it was.

Quoting your message falls under "fair use" which exists for any published
work on a web site or otherwise.

Sadly, you are right about contacting an IP lawyer.

You are partially correct,... Copyright indeed exists at creation,...
actually when it actually hits paper, disk or whatever (not while it
only exists in your head). They act of posting to the WEB or a
Newsgroup however conveys a very broad license as there are precidents
that may be used to argue that the fact of your posting gives permitted
use,... a good example is the fact that you felt comfortable in
reproducing my text from my previous post (below) without my explicit
permission. My knowledge that such replies are "usual" and that you
may well feel free to copy my test gives you my implicit permission,...
a license. That's why you must spell out limits.

Very tricky stuff this area of the law. DO seek out a lawyer who
specilizes in IP rights if your stuff is worth it. There are IP
specialty practices in most major cities.

As always, YMMV. Consult your doctor. Do not fold spindle or mutilate.
Keep away from flame. Wash in cold water only. Do not bleach. Ski in
control. Be prepared. smile

This is totally not true. No disclaimer, notice or mark is required to
preserve the copyright. In fact, explicit written notice is required to
transfer copyright or to release something in copyright to the public
domain.

The act of posting does nothing to diminish the copyright of the work.

Ah, yes but the very act of posting it gives the "user" a "license" to
"use" it for what ever purpose including monetary gain,... unless you
restrict it's use with a disclaimer,... so you are correct if you
don't
want anyone to "use it" make sure you don't post it!

If you really do have something of value I recommend you visit an
intellectual property lawyer for proper advise.

Greg queried,
If I post an image on my website, is it protected by US Copyright
laws?

Yes, with or without formal notice. If you are realy interested read

the
law http://www4.law.cornell.edu/uscode/17 However YOU are the
only
person that can bring suit if you feel some one has a "monetary
gain"
or
"monetary loss to you" from the use of your pictures. Without this
caveat any suit you might bring would be pointless.

The bottom line is if you don't want someone to copy your pictures
then
don't post them where they can be viewed by the general public.

RJ
