Pbase removes plagiarized image from bully's site
Today Pbase removed an image from Bret Douglas's gallery after a
complaint by a Professional Photographer that he had plagiarized a wedding portrait (breached copyright) belonging to the Pro. It seems Bret took an image belonging to ScottW and altered it to include a wedding Portrait he had obtained without authority. There is a warning here for everyone who posts images to the Internet and makes critical remarks about other Photographers. ScottW has something of a history of being outspoken. Apparently Bret Douglas decided he too, was fair game for his bullying and intimidation against anyone who didn't like his pictures. The fact that that this image remained on Bret's site after he was warned of pending legal action is just more damning evidence he has absolutely no regard for who he involves in his activities. Scott Fair use is subject to a balance test. A balancing test occurs in the copyright domain, when analyzing whether a particular usage of a copyrighted work constitutes "fair use". The Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPs) Article 13 allows for uses "which do not conflict with a normal exploitation of the work and do not unreasonably prejudice the legitimate interests of the right holder." If you or anyone else thinks embarrassing the image owner or causing the owner's clients to threaten legal action if the images remain in possession of the person who had no authority to take it in the first place and who committed fraud when they illegally posted them on a forged site at Pbase, complete with defamatory remarks about Doug's clients, fits anywhere in the balancing test of fair use, you really ought to give up on your attempts at understanding Copyright law. Bret Douglas could have taken down that image any time. He didn't. He left it there knowing the furor it would create when it was discovered. The man is a idiot. He is the one responsible for the crap, not me or Doug. God only know where else he's uploaded them and until I am convinced none of Doug's client's images are posted anywhere on the Internet by Bret Douglas or any of his puppets, expect to see "the crap start all over again" when I find them. So here's a warning to the image thief. Get Doug's images out of your possession if you want any hope of a peaceful time on Usenet. As for Bret Douglas calling me a liar. He is the one who stole Doug's identity and tried to break into his business account on eBay. He is the one who struck the first blow by stealing Doug's images and forging Doug's identity. If anyone can "stop the crap"it's Bret Douglas. All he has to do is get rid of the photos he has not authority or legal right to have. Only then will the crap stop.
